Mahakama ilikataa hoja ya Kyalo kwamba Bw Kiio alifariki baada ya wao kupigana wakiwa wamelewa. Tukio hilo lilitokea Aprili 16, 2018, katika Club Digital, Soko la Kikunuani Kaunti ya Machakos. Mashahidi walisema Kyalo alimpiga Bw Kiio kwa chupa za bia kichwani baada ya kudai kuwa alikuwa na bastola iliyotumiwa kumtishia babake. Inadaiwa Kyalo na wenzake walimpiga Kiio kwa chupa na fimbo, wakamvua nguo na kumtupa nje ya klabu akiwa amejeruhiwa. Kiio alipelekwa hospitalini, ambako alifariki. Uchunguzi wa maiti ulionyesha alifariki kutokana na majeraha ya kichwa yaliyosababishwa na kipigo kikali. Mahakama ilisema vitendo vya Kyalo vilionyesha nia ya kusababisha madhara makubwa hata kama alikuwa amelewa.
