Mackenzie na wenzake kujua hatima yao mwezi huu
MSHUKIWA wa mauaji ya Shakahola, Paul Mackenzie, na washtakiwa wenzake wanatarajiwa kujua hatima yao mwezi huu katika kesi inayohusu vifo vya watoto 191. Uamuzi huo unatarajiwa kutolewa mwaka mmoja baada ya kesi hiyo kuanza Septemba mwaka uliopita. Mackenzie anakabiliwa na mashtaka hayo pamoja na washtakiwa wengine 30, ambao upande wa mashtaka umedai walihusika sana katika vifo vya watoto hao. Kesi hiyo ilikuwa ya aina yake, huku Biblia, Quran na Katiba zikitajwa kwa kina na upande wa mashtaka pamoja na washtakiwa katika juhudi zao za kutetea misimamo yao. Washtakiwa walitumia aya za Biblia kuhalalisha kukaa kwao msituni na vifo vilivyofuata, huku upande wa mashtaka ukirejelea Biblia kuonyesha kwamba hata wakati wa Yesu Kristo, aina fulani za dawa zilikuwepo za kukabiliana na magonjwa na dharura, na kwamba watu hawakutegemea maombi pekee kwa ajili ya uponyaji. Wakati mmoja, kesi ya mauaji ya Shakahola iligeuka kuwa kama darasa la thiolojia, huku maswali yakiibuliwa kuhusu iwapo wale wanaodaiwa kufunga hadi kufa kwa imani kwamba wangeenda mbinguni na kukutana na Yesu, kwa hakika wako mbinguni. Hata hivyo, hakukuwa na jibu la moja kwa moja, kwani hakuna aliyeweza kusema kwa uhakika ni hatima gani iliyowakuta wale waliokufa njaa. Wakati mwingine, Mackenzie alitaka upande wa mashtaka kuthibitisha kwamba wale anaodaiwa kuwaua kupitia kufunga hawako mbinguni. "Ingawa sababu ya kifo cha baadhi ya miili haikuweza kubainishwa kimatibabu kwa sababu ilikuwa imeoza sana au kubaki mifupa pekee, mahakama inaweza kuhitimisha kwamba nao walikufa kwa njaa kutokana na mazingira yaliyozunguka vifo hivyo," alisema Naibu Mkurugenzi wa Mashtaka ya Umma, Bw Jami Yamina. Ushahidi uliowasilishwa na Serikali ulionyesha kuwa asilimia 48.9 ya miili yote iliyochunguzwa, wakiwemo watu wazima na watoto, walikufa kutokana na njaa, huku sababu ya kifo kwa asilimia 45.9 ikiwa haikubainika. Hata hivyo, washtakiwa wamejitetea kwamba ingawa kesi hiyo kuwa imezungukwa na msiba, imejaa majonzi na hisia nzito, mahakama si jukwaa la maombolezo, bali ni kitengo vha haki, kinachohitaji ushahidi. Kupitia kwa wakili wao Lawrence Obonyo, washtakiwa walisema kutokea kwa kifo pekee, hata kama ni cha kusikitisha kiasi gani, hakumaanishi moja kwa moja kwamba washtakiwa wana hatia. Bw Obonyo aliitaka mahakama isiruhusu uzito wa janga la Shakahola kufunika kile alichokitaja kuwa udhaifu na mapengo katika ushahidi wa upande wa mashtaka. Upande wa mashtaka uliita mashahidi 120 kuthibitisha kesi yake, huku washtakiwa wakiita mashahidi zaidi ya 21 kujitetea.
