Sheria za uchaguzi zakwama bungeni 2027 ikikaribia

BUNGE la Kenya linakabiliwa na kibarua kigumu cha kupitisha kwa haraka sheria muhimu za uchaguzi, huku mapendekezo kadhaa yakikwama kabla ya Uchaguzi Mkuu wa Agosti 10, 2027. Spika wa Bunge la Kitaifa, Moses Wetang'ula alikuwa ameahidi kuharakisha miswada hiyo, lakini mwaka mmoja baadaye hatua kidogo ndiyo imepigwa hali inayozua wasiwasi kuhusu maandalizi ya nchi kufanya uchaguzi huru, wa haki na wa kuaminika. Tume Huru ya Uchaguzi na Mipaka (IEBC) imeonya kuwa kutungwa au kubadilishwa kwa sheria za uchaguzi karibu sana na siku ya uchaguzi kunaweza kutatiza pakubwa mipango yake ya utekelezaji na ununuzi wa vifaa na huduma. Mageuzi mengi yanayohitajika yalitokana na mapendekezo ya Kamati ya Kitaifa ya Mazungumzo (Nadco) na yanahusu marekebisho ya Sheria ya Uchaguzi, Sheria ya Makosa ya Uchaguzi na Sheria ya Vyama vya Kisiasa. Pia kuna Mswada wa Marekebisho ya Sheria ya Ufadhili wa Kampeni za Uchaguzi na kanuni zake, zinazolenga kuhakikisha wagombeaji na vyama vya kisiasa wanapata nafasi sawa katika mashindano. Miswada hiyo ilichapishwa mnamo 2024, ikapitishwa na Seneti na kuwasilishwa kwa Bunge la Kitaifa. Hata hivyo, marekebisho ya Sheria ya IEBC kuhusu kuundwa kwa jopo la kuchagua makamishina panapotokea nafasi wazi ndiyo mafanikio makubwa pekee yaliyopatikana hadi sasa. IEBC inasema hali hiyo inakiuka mapendekezo ya Tume Huru ya Uchunguzi wa Uchaguzi (IREC), iliyoongozwa na Jaji mstaafu wa Afrika Kusini Johann Kriegler, kwamba mageuzi ya sheria za uchaguzi yafanywe angalau miaka miwili kabla ya Uchaguzi Mkuu. Bw Wetang'ula hakujibu maswali kuhusu hatua iliyopigwa katika kuharakisha miswada hiyo. Hata hivyo, Oktoba 2025 alisema Bunge lilikusudia kukamilisha kazi hiyo ndani ya miezi miwili au mitatu. Miongoni mwa miswada inayosubiri ni Mswada wa Marekebisho ya Sheria ya Uchaguzi wa 2024, ambao unapendekeza kampuni huru kufanya tathmini ya mchakato wa uchaguzi ndani ya mwaka mmoja baada ya Uchaguzi Mkuu. Mswada mwingine unapendekeza adhabu ya faini ya hadi Sh2 milioni au kifungo cha miaka mitano kwa mtu anayefanya uchaguzi katika kituo ambacho hakijatangazwa rasmi kwenye gazeti la serikali. Pia unalenga maafisa wanaochelewesha bila sababu kutangaza matokeo au kuyabadilisha kimakusudi. Wakati huohuo, Mswada wa Marekebisho ya Sheria ya Vyama vya Kisiasa unapendekeza kufutwa kwa Kifungu cha 14A, hatua ambayo inaweza kurahisisha wanasiasa kuunga mkono vyama pinzani bila kupoteza moja kwa moja nyadhifa zao za uchaguzi.
