MAHAKAMA ya Biashara iliyoko Milimani, Nairobi, imeamuru kampuni ya East African Breweries PLC (EABL) iweke Sh10 milioni katika akaunti ya pamoja inayosimamiwa na mawakili wa pande zote kusubiri kusikizwa kwa kesi ya kibiashara iliyowasilishwa na mwanahabari na mshawishi wa mitandao ya kijamii Willis Raburu. Hakimu Mkuu Mwandamizi A. Nyoike alitoa agizo hilo huku akitupilia mbali ombi la Raburu la kusimamisha au kufuta leseni ya EABL kutokana na madai ya kutolipwa ada za mkataba. Mahakama ilisema kuwa ombi hilo lilikuwa sawa na kuomba amri ya lazima, ambayo Raburu hakufikia kiwango cha kisheria kinachohitajika ili kutolewa. Kupitia kampuni yake ya Steizon Limited, Raburu alishtaki Game Changer Marketing Limited pamoja na EABL akidai aliajiriwa kutoa huduma za ushawishi wa kidijitali, kuvumisha chapa, kuratibu hafla na matangazo ya mitandaoni katika tamasha la Furaha City Festival lililofanyika Desemba 2024. Alidai kuwa pande hizo zilikubaliana malipo Sh10 milioni, lakini hadi sasa hajalipwa. Raburu alisema alitekeleza kikamilifu wajibu wake, ikiwa ni pamoja na kutengeneza zaidi ya video 60 fupi za mitandaoni, machapisho zaidi ya 100, kuratibu washawishi wa mitandao ya kijamii na kusimamia shughuli za hafla hiyo. Aliongeza kuwa aliwasilisha ripoti baada ya tamasha na mara kadhaa kudai malipo, lakini juhudi hizo hazikuzaa matunda. Kwa upande wake, Game Changer Marketing ilikana kumwajiri Raburu kwa shughuli za Furaha City Festival. Kampuni hiyo ilisema ushirikiano wake na Raburu ulihusu tu kampeni ya awali ya Chrome Wabebe Campus Caravan, ambayo ilisema tayari alilipwa baada ya EABL kuidhinisha gharama na kutoa agizo rasmi la ununuzi. Nayo EABL ilikana kuwajibika ikisema tamasha la Furaha City lilikuwa sehemu ya mwisho ya kampeni ya Wabebe na si mradi mpya uliostahili malipo mengine. Aidha, ilisema hakukuwa na agizo jipya la ununuzi wala mkataba uliotiwa saini unaounga mkono madai ya Raburu ya Sh10 milioni. Katika uamuzi wake, Hakimu Nyoike alisema Raburu ameibua masuala yanayostahili kusikilizwa wakati wa kesi kamili. Hata hivyo, alisema ushahidi uliowasilishwa na pande zote mbili unakinzana na hawezi kutolewa uamuzi wa mwisho kupitia ombi la awali. "Ushahidi unaokinzana lazima uchunguzwe wakati wa kusikiliza kesi," alisema hakimu. Aliongeza kuwa Raburu hakuthibitisha kuwepo kwa "haki iliyo wazi na isiyoweza kutiliwa shaka" inayohitajika ili apewe amri ya lazima aliyoomba. Mahakama pia ilikataa hoja ya EABL kwamba kesi hiyo ilizimwa kwa kuwa kulikuwa na kesi nyingine inayohusu suala hilo katika Mahakama Kuu. Hakimu alisema kampuni hiyo haikuthibitisha kuwa kesi hiyo ilikuwa bado inaendelea baada ya Raburu kuonyesha kwamba ilikuwa imeondolewa. Hata hivyo, licha ya kukataa kuamuru EABL imlipe Raburu mara moja Sh10 milioni zinazodaiwa, mahakama iliagiza kampuni hiyo kuweka kiasi hicho katika akaunti ya pamoja inayosimamiwa na mawakili wa pande zote kama dhamana hadi kesi hiyo itakapoamuliwa.
