Kwa mujibu wa Sonko, aliwasilisha ombi rasmi akimtaka Jaji Mkuu ajiondoe katika kesi hiyo kwa madai kuwa kauli hizo zilionyesha upendeleo, lakini ombi lake lilikataliwa. "Wakati rufaa yangu ilikuwa bado inasikilizwa Mahakama ya Juu, Jaji Mkuu alisema katika mahojiano na Spice FM kwamba gavana aking'olewa hubaki ameng'olewa. Kwa kuwa kesi ilikuwa bado haijaamuliwa, niliona kauli hizo zilitoa taswira kwamba uamuzi ulikuwa tayari umefikiwa. Niliandika nikitaka ajiondoe katika kesi hiyo lakini alikataa na akaendelea kushiriki katika kutoa hukumu. Hilo linanifanya niulize: Je, uamuzi kuhusu rufaa yangu ulikuwa tayari umeamuliwa?" alisema. Pia alihoji msururu wa matukio yaliyoishia na hukumu ya Mahakama ya Juu. Alisema kuwa mnamo Julai 13, 2022, Mahakama Kuu ya Mombasa iliamua kwamba kwa kuwa rufaa yake Mahakama ya Juu ilikuwa bado haijakamilika, alikuwa hajamaliza njia zote za kisheria na hivyo alikuwa na haki ya kuidhinishwa na Tume Huru ya Uchaguzi na Mipaka (IEBC) kugombea ugavana wa Mombasa. Hata hivyo, Sonko alisema Mahakama ya Juu ilimwagiza kuwasilisha hoja zake ndani ya saa chache akiwa bado katika Mahakama Kuu ya Mombasa, ikasikiliza kesi hiyo Julai 14 na kutupilia mbali rufaa yake Julai 15. Pia alinukuu uamuzi wa Mahakama ya Afrika Mashariki (EACJ), akisema mahakama hiyo ilibaini mapungufu ya kiutaratibu katika jinsi kesi yake ilivyoshughulikiwa. Kwa mujibu wa Sonko, mahakama hiyo ya kikanda iliamua kuwa baadhi ya hatua zilizochukuliwa zilikiuka haki yake ya kupata kesi ya haki chini ya Katiba ya Kenya na hazikuendana na misingi ya utawala bora, utawala wa sheria na uwajibikaji iliyoainishwa katika Mkataba wa Jumuiya ya Afrika Mashariki. Sonko alisema masuala anayoyaibua hayahusu kesi yake pekee, bali yanagusa uhuru wa mahakama, uwazi na imani ya wananchi kwa mfumo wa haki. "Maswali yangu kwa Mahakama ya Juu ni rahisi. Kwa nini kauli zilitolew hadharani kuhusu kesi iliyokuwa bado mahakamani? Kwa nini ombi langu la Jaji Mkuu kujiondoa lilikataliwa? Kwa nini nilipewa saa chache tu kuwasilisha hoja badala ya muda wa kawaida? Kwa nini kulikuwa na haraka ya kumaliza rufaa yangu wakati suala la kustahili kwangu kugombea ugavana wa Mombasa lilikuwa bado linashughulikiwa na mahakama nyingine? Na sasa kwa nini Mwanasheria Mkuu anaombwa kutoa ushauri kuhusu jambo ambalo Mahakama ya Juu tayari iliamua katika kesi yangu?" alihoji. .
