SHERIA: Mipango yaatanisho haizuii mtu kuwasilisha kesi ya talaka
WANANDOA katika ndoa za kiraia hawalazimiki kusubiri juhudi za upatanisho zikamilike kabla ya kuwasilisha kesi ya kutengana au kuvunja ndoa. Sheria inaruhusu mmoja wa wanandoa kuwasilisha mahakamani kesi ya kutengana au kuvunja ndoa hata kama juhudi za kuwapatanisha bado zinaendelea. Hata hivyo, wanandoa hao lazima wawe wamekaa kwenye ndoa hiyo kwa angalau miaka mitatu kabla ya kuwasilisha ombi la kutengana au kuvunja ndoa. Sheria inaeleza kuwa mtu aliye katika ndoa ya kiraia anaweza kuomba kutengana au kuvunja ndoa kwa misingi maalum. Misingi hiyo ni pamoja na uzinzi wa mchumba wake, ukatili, tabia mbaya kupita kiasi, kutelekezwa na mchumba kwa angalau miaka mitatu au ndoa kuvunjika kabisa kiasi kwamba haiwezi kurekebishwa. Muhimu zaidi ni kwamba sheria haimlazimishi mtu kusubiri hadi juhudi za upatanisho zifanikiwe au zishindikane. Inasema wazi kuwa mtu anaweza kuwasilisha kesi ya kutengana au kuvunja ndoa "licha ya juhudi zozote za kuwapatanisha wanandoa." Hii ina maana kwamba kuwepo kwa mazungumzo ya kifamilia, usuluhishi au juhudi nyingine za kuokoa ndoa hakumzuii mmoja wa wanandoa kufika mahakamani. Hata hivyo, mahakama yenyewe inaweza kuamua kupeleka mzozo wa ndoa katika mchakato wa upatanisho iwapo wahusika watakubaliana. Pia, kesi ya kuvunja ndoa inaweza kuahirishwa kwa muda usiozidi miezi sita ili mahakama ifanye uchunguzi zaidi au kuwapa wanandoa nafasi nyingine ya kujaribu kusuluhisha tofauti zao. Sheria pia inaeleza mazingira ambayo ndoa inaweza kuchukuliwa kuwa imevunjika kabisa. Mbali na uzinzi na ukatili, ndoa inaweza kuchukuliwa kuwa imevunjika ikiwa mmoja wa wanandoa amempuuza mwenzake kimakusudi kwa angalau miaka miwili kabla ya kesi kuwasilishwa. Kutengana kwa wanandoa kwa angalau miaka miwili, iwe kwa hiari au kwa amri ya mahakama, pia ni sababu inayoweza kuonyesha kuwa ndoa imevunjika. Kutelekezwa kwa angalau miaka mitatu ni msingi mwingine. Aidha, kifungo cha maisha au kifungo cha miaka saba au zaidi kinaweza kuwa sababu ya ndoa kuchukuliwa kuwa imevunjika. Sheria pia inatambua hali ambapo mmoja wa wanandoa anaugua ugonjwa wa akili usiotibika, iwapo madaktari wawili, mmoja akiwa na ujuzi au uzoefu katika taaluma ya magonjwa ya akili, watathibitisha kuwa hali hiyo haiwezi kutibiwa au uwezekano wa kupona ni mdogo. Mahakama pia inaweza kutambua sababu nyingine yoyote inayofaa kulingana na mazingira ya kesi. Kwa hivyo, juhudi za familia, marafiki au wahusika wengine za kuokoa ndoa haziondoi haki ya mmoja wa wanandoa kuwasilisha kesi mahakamani. Badala yake, sheria inaacha milango yote miwili wazi: wanandoa wanaweza kujaribu kusuluhisha tofauti zao, lakini pia mmoja wao anaweza kuamua kufuata mchakato wa kisheria wa kutengana au kuvunja ndoa iwapo masharti yaliyowekwa yametimizwa.
