Anasema baadaye alitia saini mkataba na kampuni ya teknolojia ya Amerika, Tesxo, kuunda mfumo huo chini ya mradi uliopewa jina la siri "Numera 2023". Hata hivyo, anadai serikali haikutekeleza ahadi zake za kifedha, hali iliyomfanya ashindwe kumlipa mkandarasi huyo na hivyo kukabiliwa na adhabu ya kukiuka mkataba. Katika hati zake, Bi Wachuka anadai alielezwa kuwa mradi huo ungefadhiliwa kupitia fedha za siri za Wizara ya Fedha na kwamba Bw Saini ndiye angesimamia utoaji wa fedha kutokana na usiri wa mradi huo. Madai hayo yanapingwa na washtakiwa. Mahakama ilisema kuwapo kwa Bw Kiptoo na Bw Koskei katika kesi hiyo ni muhimu kwa kuwa madai dhidi yao yanahusu hatua au kutokuchukua hatua kunakodaiwa kulisababisha walalamishi kuingia kwenye mradi huo. "Kuwepo kwa washtakiwa wa kwanza na wa pili kutaiwezesha mahakama kubaini iwapo Serikali ya Kenya kupitia maafisa wake ilitoa maelezo yaliyowafanya walalamishi kuchukua hatua zilizowasababishia hasara," ilisema mahakama. Jaji alisisitiza kuwa katika hatua hiyo mahakama haikuwa inaamua kama madai ya mlalamishi ni ya kweli au la, bali ilikuwa inachunguza iwapo kuna hoja zinazostahili kusikilizwa katika kesi kamili. Mahakama ilisema mfumo wa sheria unataka kila upande upewe nafasi ya kusikilizwa na mgogoro kuamuliwa kwa kuzingatia ushahidi wote utakaowasilishwa. Baada ya kupitia madai ya Bi Wachuka pamoja na vielelezo vilivyowasilishwa, ikiwemo mawasiliano ya WhatsApp, jaji alisema walalamishi wamewasilisha hoja zinazotosha kuhalalisha kuendelea kwa kesi hiyo.
